1. Acceptance of Terms

By accessing or using KDP Builder (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We may update these terms from time to time, and your continued use constitutes acceptance of any changes.

2. Description of Service

KDP Builder is an AI-powered book creation platform that helps users research, write, edit, design, format, and export publish-ready books. The Service uses artificial intelligence to assist with content generation, cover design, interior formatting, and metadata creation. The Service is a tool — you are responsible for reviewing, editing, and approving all output before publishing.

3. User Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must be at least 13 years old to use the Service.
  • One account per person. Automated account creation is prohibited.

4. Content Ownership and Rights

Your content belongs to you.

  • All content you create or generate through KDP Builder — including manuscripts, covers, interiors, metadata, and book packages — belongs to you.
  • You have full commercial rights to publish, sell, distribute, and monetize your generated content on any platform, without restriction.
  • You may publish on Amazon KDP, IngramSpark, Apple Books, your own website, or any other platform.
  • KDP Builder does not claim ownership of, or any license to, your generated content.
  • KDP Builder retains ownership of its software, algorithms, and platform technology.

5. AI-Generated Content Responsibility

  • Content generated by AI may contain factual errors, inconsistencies, or biases. You are responsible for reviewing and fact-checking all content before publishing.
  • KDP Builder does not guarantee the accuracy, originality, or quality of AI-generated content.
  • You are responsible for complying with platform-specific requirements, including Amazon KDP’s AI content disclosure policy and any other publisher guidelines.
  • You are responsible for ensuring your published content does not infringe on third-party copyrights or trademarks.
  • The AI disclosure included in generated copyright pages is provided as a convenience. You may modify it to meet your specific publishing platform’s requirements.

6. Credits and Payment

  • KDP Builder uses a credit-based pricing system. Credit costs are displayed before each operation.
  • One-time credit packs do not expire.
  • Subscription credits roll over for one billing cycle. Unused subscription credits expire at the end of the second billing cycle.
  • Credits are non-transferable between accounts.
  • All payments are processed securely through Stripe.

7. Prohibited Uses

You may not use the Service to:

  • Generate content that promotes violence, hate speech, illegal activities, or exploitation
  • Create content designed to deceive, defraud, or harm others
  • Violate any applicable laws or regulations
  • Attempt to reverse-engineer, scrape, or extract the underlying AI models or algorithms
  • Create automated accounts or use bots to consume credits
  • Resell or sublicense access to the Service without authorization

8. Service Availability

We aim to provide reliable, uninterrupted service, but we do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any loss or damage resulting from service interruptions.

9. Account Termination

  • You may delete your account at any time by contacting support.
  • We may suspend or terminate accounts that violate these Terms, engage in fraud, or abuse the Service.
  • Upon termination, your content will be retained for 30 days to allow data export, then permanently deleted.
  • Unused credits are forfeited upon account termination for cause.

10. Limitation of Liability

KDP Builder is provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
  • Our total liability to you shall not exceed the amount you paid to KDP Builder in the 12 months prior to the claim.
  • We are not responsible for Amazon KDP rejections, publishing platform decisions, or commercial performance of books created with the Service.

11. Indemnification

You agree to indemnify and hold harmless KDP Builder, its operators, and affiliates from any claims, damages, or expenses arising from your use of the Service, your published content, or your violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
